1. Acceptance of Terms
Welcome to PASI ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and PASI governing your access to and use of our educational platform, including our website, mobile applications, services, and all related content (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of our Services.
We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our Platform. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
2. Eligibility and Account Registration
2.1 Age Requirements: You must be at least 13 years of age to use our Services. Users between 13 and 18 years of age must have parental or legal guardian consent. By using our Services, you represent and warrant that you meet these age requirements.
2.2 Account Creation: To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your account credentials
- Immediately notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
- Not create multiple accounts or share accounts with others
2.3 Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose security risks to our Platform or other users.
3. Subscription and Payment Terms
3.1 Subscription Plans: We offer various subscription tiers providing different levels of access to our educational content, past papers, mock exams, and related materials. Subscription details, features, and pricing are available on our Platform.
3.2 Payment Processing: All payments are processed securely through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method. You agree to pay all fees and applicable taxes associated with your subscription.
3.3 Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. You will be charged the then-current subscription fee. You may cancel automatic renewal through your account settings or by contacting customer support.
3.4 Price Changes: We reserve the right to modify subscription fees. Price changes will be communicated at least 30 days in advance and will apply to subsequent billing cycles. Continued use of the Services after a price change constitutes acceptance of the new pricing.
3.5 Refund Policy: Refunds are provided at our discretion and typically limited to cases of:
- Technical issues preventing access to paid features
- Duplicate or erroneous charges
- Service cancellation within 7 days of initial purchase (subject to usage restrictions)
Refund requests must be submitted within 30 days of the charge. Refunds are not provided for partial billing periods or unused portions of subscriptions.
4. Intellectual Property Rights
4.1 Platform Ownership: All content, materials, features, and functionality of our Services, including but not limited to text, graphics, logos, images, software, past exam papers, mock exams, specifications, educational resources, and compilations thereof (collectively, "Platform Content"), are owned by PASI, its licensors, or other content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
4.2 Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial educational purposes only.
4.3 Prohibited Uses: You may not:
- Copy, reproduce, distribute, publish, or create derivative works from Platform Content
- Download, store, or archive educational materials except as expressly permitted
- Use automated systems (bots, scrapers) to access or extract content
- Remove, alter, or obscure copyright, trademark, or proprietary notices
- Reverse engineer, decompile, or disassemble any software or technology
- Share, resell, or commercially exploit Platform Content
- Use Platform Content for training AI models or machine learning systems
4.4 Third-Party Content: Certain educational materials may be sourced from or reference third-party exam boards, educational institutions, or content providers. Such content remains the property of its respective owners and is used in accordance with applicable licensing agreements or fair use principles.
5. Mock Exam and Assessment Services
5.1 Mock Exam Terms: When participating in mock exams or assessments, you agree to:
- Complete assessments within specified time limits and deadlines
- Submit your own original work without unauthorized assistance
- Not share, reproduce, or discuss exam questions with others during active exam periods
- Follow all exam guidelines and academic integrity policies
- Not use unauthorized materials or resources during timed assessments
5.2 Results and Feedback: Mock exam results, scores, and feedback are provided for educational purposes only and do not constitute official certifications, qualifications, or guarantees of performance on actual examinations. Results are final and not subject to appeals or reconsideration except in cases of technical errors.
5.3 Academic Integrity: Violations of academic integrity, including cheating, plagiarism, or unauthorized collaboration, may result in immediate account termination and reporting to relevant educational institutions or authorities.
5.4 Upload and Submission: When uploading answer scripts or materials, you grant us a non-exclusive, worldwide license to process, store, and review your submissions for the purpose of providing assessment and feedback services. We do not claim ownership of your submitted work.
6. User Conduct and Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws, regulations, or third-party rights
- Uploading malicious code, viruses, or harmful content
- Attempting to gain unauthorized access to systems or accounts
- Interfering with or disrupting Platform operations or infrastructure
- Impersonating others or providing false information
- Harassing, threatening, or abusing other users or our staff
- Circumventing security measures, paywalls, or access controls
- Using the Platform for any illegal, fraudulent, or unauthorized purpose
- Collecting or harvesting user information without consent
- Creating derivative services that compete with our Platform
Violation of these conduct rules may result in immediate account suspension or termination, removal of content, and legal action where appropriate.
7. Service Availability and Modifications
7.1 Service Access: We strive to provide reliable and uninterrupted access to our Services. However, we do not guarantee that the Services will be available at all times or free from errors. Access may be interrupted for maintenance, updates, or circumstances beyond our control.
7.2 Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Services, including features, functionality, or content, with or without notice. We will make reasonable efforts to notify users of material changes that negatively impact paid services.
7.3 Third-Party Dependencies: Our Services may integrate with or depend on third-party services. We are not responsible for the availability, accuracy, or performance of third-party services.
8. Disclaimers and Educational Purpose
8.1 Educational Tool Only: Our Services are designed as educational supplements and study aids. We make no representations or warranties regarding:
- Accuracy or completeness of educational content
- Suitability for specific educational objectives or exam syllabi
- Correlation between mock exam performance and actual exam results
- Achievement of specific grades, scores, or educational outcomes
8.2 No Professional Advice: Content provided through our Services is for informational and educational purposes only and does not constitute professional educational advice, tutoring services, or official examination preparation endorsed by examination boards.
8.3 "AS IS" Provision: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PASI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Educational outcomes, exam results, or academic performance
- Service interruptions or data loss
- Costs of procurement of substitute services
- Any matter beyond our reasonable control
WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless PASI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) your violation of any applicable laws or regulations; or (e) any content or information you submit through the Services.
11. Termination and Suspension
11.1 Termination by User: You may terminate your account at any time through account settings or by contacting customer support. Cancellation of paid subscriptions takes effect at the end of the current billing period.
11.2 Termination by PASI: We reserve the right to suspend or terminate your access to the Services, with or without notice, for:
- Violation of these Terms or our policies
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Non-payment of fees
- Requests by law enforcement or government agencies
11.3 Effect of Termination: Upon termination, your right to access and use the Services immediately ceases. We may delete your account data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Dispute Resolution and Arbitration
12.1 Informal Resolution: Before pursuing formal legal action, you agree to first contact us at info@pasi.life to attempt to resolve any dispute informally. We will attempt to resolve the dispute through good faith negotiations.
12.2 Binding Arbitration: If informal resolution is unsuccessful, any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, rather than in court, except that you may assert claims in small claims court if your claims qualify.
12.3 Class Action Waiver: YOU AND PASI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PASI operates, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in that jurisdiction for the purpose of litigating all claims or disputes not subject to arbitration.
14. General Provisions
14.1 Entire Agreement: These Terms, together with our Privacy Policy and any supplemental terms, constitute the entire agreement between you and PASI regarding the Services.
14.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
14.4 Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
14.5 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, labor disputes, or governmental actions.
